Wrongful birth lawsuit creates outrage in KC

SHAWNEE, Kan. – A Portland-area couple is receiving death threats and sparking controversy all over the country. On Friday, Ariel and Deborah Levy were awarded $2.9 million in a ‘wrongful birth lawsuit’.

According to the Levy’s lawyer, the couple would have aborted the child had they known she had Down syndrome. In a 10-day trial, he argued that professionals at the Legacy Health System misread. Those inaccurate reads, he said, led to a false-negative for Down syndrome.

Attorney David Miller said the case was never about abortion, “I think the jury was asked to consider, ‘Was this medical procedure done negligently? And if it was, what are the financial consequences for this family?’”

A 12-person jury decided to award the Levys almost $3 million, which they plan to put toward their daughter’s medical and therapy costs.

The daughter is now 4 years old.
